Terms and Conditions
The Property Owner (hereinafter referred to as the Owner) agrees to the following:
The Owner understands that using only Race Real Estate, SelfManageProperties.com and CallMyProperty services the Owner is acquiring those services as customer (Tenant/Occupant) service provider and not as a full property manager as SMP is not acting on site, in person neither under any such contract nor acting in negotiation on behalf of the Owner. These services may be available separately under separately signed contract from these Terms and Conditions with a full property manager within SMP.
Self Manage Properties (hereinafter referred to as SMP) and its subsidiary's will not be liable for the performance of third party contractors, the actions of occupants, the words, comments and directions of service employees. SMP will attempt to resolve any disputes on the Owners behalf including poor workmanship, incomplete work, or failed to perform issues.
The Owner agrees to default pricing by all contractors for the purpose of call-out fees and emergency response work. Work that cost is above the call-out plus two hours of work OR one hour of work and one hour of work in material cost may be completed without further permission from the Owner (generally up to $500) but work which may exceed this amount must receive permission from the owner prior to completion. If the work does exceed these conditions the Owner must pay up to at least $500 and dispute the balance or the work afterward. The Owner can apply to SMP and SMP will attempt to mediate cost disputes as SMP may have group rates or purchasing power with the provider.
The Owner will maintain full insurance on their property against, but not limited to, liability, water damage, fire damage, damage due to negligence and willful damage (vandalism by tenant).
